Thermocline is a planning and decision-support tool for recreational offshore fishing. Its verdicts, scores, maps, and forecasts are estimates produced from weather models and satellite data that can be wrong — sometimes badly wrong, and exactly when it matters most. Thermocline is not a navigation device, not a substitute for official marine forecasts and warnings from the National Weather Service or your local authority, and not a substitute for your own seamanship.
As the captain, you alone are responsible for the decision to leave the dock, for the safety of your vessel and everyone aboard, and for turning around when conditions differ from any forecast. A "GO" from Thermocline is an opinion about data, never a guarantee about the ocean. Always check official sources, always file a float plan, and always trust your eyes over any screen.
By creating an account or using the Thermocline app or its services (the "Service"), you agree to these Terms. If you do not agree, do not use the Service. The Service is operated by Obsidian Aerial Solutions LLC ("we", "us").
Thermocline aggregates public marine data (forecasts, buoy observations, satellite imagery, ocean models) and applies scoring models to help you plan fishing trips. Data sources can be delayed, gap-filled, or unavailable; models are calibrated estimates. We may change, suspend, or discontinue any part of the Service at any time. During the current test phase, features are provided free of charge and may change without notice.
Accounts are managed through our authentication provider. You are responsible for the activity on your account and for keeping your credentials secure. You must be at least 18 years old (or the age of majority where you live) to use the Service.
Trips, waypoints, catch logs, and boat details you enter remain yours. You grant us the limited license needed to store and process them to operate the Service (for example, scoring your trips and computing your private statistics). We do not sell your content. See the Privacy Policy.
Do not misuse the Service: no attempting to break, overload, reverse-engineer, or scrape it; no reselling its data feeds; no using it for commercial navigation or for any purpose where an error in the data could lead to death, personal injury, or environmental damage beyond the inherent risks of recreational boating that you accept as captain.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR AVAILABILITY. WE DO NOT WARRANT THAT FORECASTS, VERDICTS, OR ANY DATA WILL BE ACCURATE, COMPLETE, OR TIMELY.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OBSIDIAN AERIAL SOLUTIONS LLC AND ITS MEMBERS, OFFICERS, AND SUPPLIERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF LIFE, PERSONAL INJURY, VESSEL DAMAGE, OR OTHER LOSSES ARISING FROM RELIANCE ON THE SERVICE OR FROM YOUR DECISION TO GO (OR NOT GO) ON ANY TRIP. WHERE LIABILITY CANNOT BE EXCLUDED, IT IS LIMITED TO THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM (DURING THE FREE TEST PHASE: ZERO).
You will indemnify and hold us harmless from claims arising out of your use of the Service, your violation of these Terms, or your operation of any vessel.
The Service displays data from NOAA, the National Weather Service, NASA, the E.U. Copernicus Marine Service, Esri, Open-Meteo, and others. That data belongs to its providers and is subject to their terms; we credit sources in the app's map-credits panel.
You may stop using the Service at any time and request account deletion (see the Privacy Policy). We may suspend or terminate accounts that violate these Terms.
We may update these Terms; material changes will be reflected by the "Last updated" date above. Continued use after changes means acceptance.
These Terms are governed by the laws of the State of New Jersey, USA, without regard to its conflict-of-law rules. Venue for disputes is the state or federal courts located in New Jersey.
